1. Introduction
Please read these Terms of Use ("Terms") carefully before using the ExSolver application available at https://app.exsolver.com ("Application" or "Website"). These Terms constitute a legally binding agreement between you ("User" or "you") and ExSolver, Poland ("Provider", "we", or "us").
By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, you are not authorized to access or use the Application.
2. Definitions and general provisionsApplication: The online software tool named "ExSolver", accessible via https:///app.exsolver.com, engineered to assist in determining gas explosive hazardous areas based on the EN-IEC 60079-10-1:2021 Edition 3.0 standard.User: Any individual, legal entity, or organizational unit without legal personality that registers an account and purchases access to the Application.Access Period: The non-renewable, fixed timeframe during which the User is granted access to the Application's functionalities ("Project" or "Project Plus").Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by, interpreted, and construed exclusively in accordance with the laws of Poland.3. Character of the application and User qualificationsThe Application is a calculation tool intended to assist and support the process of determining gas explosive hazardous areas according to the EN-IEC 60079-10-1:2021 Edition 3.0.Nature of the Tool and Disclaimer of Outcomes: The Application serves strictly as an engineering support tool designed to streamline calculations. While the Provider makes every effort to ensure the technical quality of the software, ExSolver assumes no responsibility or liability for the correctness, accuracy or consequences of the generated results.User Competence and Final Validation: The proper use of the Application and the correct interpretation of its outputs require specialized engineering knowledge and professional competence regarding explosive atmospheres. The User bears sole responsibility for the final verification, validation, and implementation of any data or results generated by the Application.4. Access packages and pricingAccess to the Application is paid and divided into two distinct, fixed-term packages:"Project" Package: Access for a continuous period of 1 (one) month at the price of 259 EUR."Project Plus" Package: Access for a continuous period of 3 (three) months at the price of 599 EUR.Net Prices: All prices listed on the Website or provided by the Provider are strictly net prices. They do not include Value Added Tax (VAT) or any other applicable statutory taxes, levies or financial transaction fees, which will be calculated and added in accordance with prevailing tax regulations.Non-Renewable Access: The chosen subscription package does not renew automatically. Upon the natural expiration of the purchased Access Period, the User’s access to the Application’s features automatically terminates. To restore access, the User must explicitly initiate and complete a new purchase.5. Payment and account activationInvoicing: Payments are processed traditionally based on a commercial pro-forma invoice or standard commercial invoice issued directly by the Provider to the User. No automated electronic payment processors are integrated into the Website.Access Provisioning: The Provider shall grant the User functional access to the Application within a maximum timeframe of 24 hours from the exact moment the full payment amount is successfully credited and cleared in the Provider’s designated bank account.Credentials & Password Policy: Upon account activation, the User will receive an automated email containing a system-generated username (login) and a temporary password. The User is strictly required to change the temporary password immediately upon their first login to a unique, highly secure
password that complies with the Application’s built-in password policy. The User is entirely responsible for maintaining the strict confidentiality of their active login credentials.
6. Refund policy and consumer rightsFinal Sale (No-Refunds): All purchases of Access Periods are final, irrevocable, non-cancellable, and completely non-refundable under any regular circumstances once access is provisioned.Consumer Information (B2C): Although the Application is custom-designed and primarily targeted at Business-to-Business (B2B) professionals, individual physical persons acting as consumers (B2C) are not prohibited from purchasing access.Explicit Waiver of Withdrawal Right: By completing the purchase, requesting the invoice, and logging into the Application for the first time, the User (including Users qualifying as consumers under European Union law) explicitly requests and demands the immediate performance of the digital service prior to the expiration of the statutory 14-day cancellation window. The User hereby acknowledges and agrees that by doing so, they definitively forfeit their statutory right of withdrawal from the contract under the EU Digital Content Directive and corresponding local consumer protection enactments.7. Absolute limitation of liability"As-Is" Service: The Application is provided strictly on an "AS IS" and "AS AVAILABLE" basis. The Provider makes no warranties, guarantees, or representations of any kind, whether express, implied, statutory or otherwise, regarding the operational availability, uptime, complete error-free functionality, or fitness for any general or specific purpose of the software.No Guarantee of Availability: The Provider does not guarantee uninterrupted, secure, or stable access to the Application. Necessary system maintenance, updates, technical optimization, server overloads, or external force majeure events may temporarily suspend access without prior notice and without establishing any form of liability on the side of the Provider.Total Exclusion of Liability for Damages: To the maximum extent permitted by applicable governing law, the Provider shall not be held liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages. This includes, without limitation, damages for loss of business profits, loss of commercial goodwill, data corruption, project delays, business interruption, industrial or site accidents, regulatory non -compliance fines, or any other tangible or intangible losses arising out of the use of, or inability to safely use, the Application or its calculations.Maximum Financial Cap: In any circumstance where the absolute exclusion of liability is deemed invalid or unenforceable under prevailing jurisdiction, the Provider’s maximum aggregate financial liability to the User for any and all combined claims arising out of or related to these Terms or the Application shall be strictly capped and limited to the exact amount of the last payment successfully received by the Provider from that specific User for their current or most recent Access Period.8. Data confidentiality and securityStrict Privacy of Project Data: The Provider guarantees full, comprehensive, and unconditional confidentiality regarding any technical data, variables, engineering parameters, environmental factors, or project details entered into the Application by the User.No Data Inspection: The Provider expressly declares that it does not inspect, view, monitor, copy, store for external extraction, sell, or analyze the data inputted by the User into their projects within the Application, unless explicitly requested in writing by the User for technical support or debugging purposes.9. Final provisions and jurisdictionSeverability: If any individual provision of these Terms is determined to be unenforceable, illegal, or invalid under any applicable law, such unenforceability or invalidity shall not affect or render the remaining provisions of these Terms invalid as a whole; instead, the invalid term shall be replaced by a valid one closest to the original commercial intent.Amendments: The Provider reserves the right to modify, adjust, or rewrite these Terms at any time. Continued use of the Application after any such updates are officially posted on the Website constitutes full and unreserved acceptance of the revised Terms.Dispute Resolution: Any dispute, controversy, or legal claim arising out of, or relating directly or indirectly to these Terms, including their validity, breach, or termination, shall be submitted to the exclusive jurisdiction of the common court of law having territorial jurisdiction over the registered seat of the Provider in Warsaw, Poland.

2. Is ExSolver available on mobile devices (tablets or smartphones)?
ExSolver was primarily designed as a desktop application and is recommended for desktop use. The app also works on phones and tablets; however, some limitations related to proper interface display may occur on mobile devices.
3. Can I access my projects after my subscription expires?
Yes. You can export your projects to your local device and re-import them after renewing your subscription.
4. Who is ExSolver intended for?
ExSolver is designed for safety engineers, occupational safety and health inspectors, plant designers, and ATEX specialists involved in the classification of hazardous areas and the explosion risk assessment. Users should be familiar
with IEC 60079-10-1, as the application supports the process but does not replace applicable standards or regulations.
5. What if I need to specify a zone for a substance that isn't listed in the software?
We strive to include the most common substances in our core substance database. If you can’t find the substance you’re looking for, you can add it and assign its physical and chemical properties. From now on, every time you launch the app, the new substance will appear in the drop-down list.
6. Can I export or save my calculation results?
Yes, you can save your calculation results and return to them at any time via the navigation bar, where your saved work is stored. You can also pause the process of estimating hazardous explosion zones, save your current progress, and continue your work whenever it’s convenient for you.
7. Is my data secure and stored privately?
Yes, your data is secure and stored privately. All calculation results, input data, projects, and user-defined substances are accessible only to you and are not visible to other users. We use trusted cloud infrastructure to ensure your data is protected and handled safely.
8. Can I generate editable reports?
Yes, the app allows you to generate a PDF report for a specific emission scenario. You can also export an Excel table that includes all defined emission scenarios along with their corresponding results.
